1. Productions Specifications
1.1 We have a policy of continuous product
development and reserve the right to amend the specification of any goods
or product without prior notice in relation to future sales.1.2
Products supplied may differ as a consequence from those on display or advertised
unless agreed with you, the products supplied will be of equivalent value
, functionality and appearance.1.3
Some kitchen furniture is made from quality natural wood and accordingly appearances
may vary. Some woods will mellow with age and exposure to sunlight. 1.4 We
endeavour to display as accurately as possible the colours of our products
that appear on the website or any of the marketing created by Signature Kitchen
Ltd. However we cannot guarantee the complete accuracy of the pictures or
photographs that are shown.
2. Measurements
2.1 We will not accept any liability for
any extra costs incurred by you as a result of incorrect of incomplete measurements
or information supplied by you. 2.2 All dimensions specified by us are approximate.
3. Prices
3.1 All prices include VAT, where appropriate,
at the prevailing rate and are subject to any promotional offer or discount.
3.2 Goods are delivered on weekdays directly to your home address if you live
within the UK mainland and Northern Ireland. For weekend delivery, if available,
a surcharge may apply. For delivery to the Channel Island, the Isle of Man,
the Scottish Islands or the Republic of Ireland additional delivery charges
may also apply. You will be advised of these additional delivery charges if
you telephone our telesales number on 0845 388 1491 before you complete your
purchase. 3.3 We will not bound to honour any prices, where we have indicated
to you subsequently that the prices displayed have been displayed in error.
4. Payment
4.1 Deposits must be made by cash, cheque
or a bankers draft. The price of any product is the price in force at the
date and time of your order. 4.2 Payment for the goods may be made on delivery
by guaranteed payment (cash, bankers draft) otherwise payment must be received
10 days in advance of delivery date. 4.3 The contract shall not have been
concluded until we have received your deposit. We are entitled to refuse any
order placed by you.
5. Delivery
5.1 We will endeavour to fulfil your order
by the date set out in the contract. If this is not possible we shall endeavour
to fulfil your order within thirty (30) days. 5.2 For all orders - any changes
made to the content of your order will have an impact on your delivery date.
We may therefore be unable to deliver goods on your confirmed delivery date
should changes occur and if so, a new delivery date will be given. Should
the customer want to change the confirmed delivery date specified on the contract
they will be subject to a minimum charge of £50.00 per delivery date change.
5.3 You are responsible for providing a safe means of access from the public
highway to the place of delivery. If our delivery staff consider that access
is unsafe then we will not deliver the goods until safe access is provided.
5.4 If you are unable, for whatever reason to take delivery of your goods
on the confirmed delivery date or we are unable to deliver the goods due to
there being no safe means of access to the place of delivery we shall be entitled
to cancel you r order and refund your payment less an administration fee of
20% of the order value (up to a maximum of £500 including VAT). 5.5 If we
accidentally damage goods in the course of delivery our liability for that
damage is limited to the repair, replacement or refund of the goods or the
value thereof. Time of delivery is not of the essence in these terms and conditions.
We will not be liable for any loss of damage suffered by you through any reasonable
delay or delay due to unforeseen circumstances outside of the reasonable control
of Signature Kitchen Ltd.
6. Installation
6.1 We are a supply only company, but
if you would like to take advantage of one of our recommended fitters please
contact your local store. 6.2 All appliances supplied by you the customer
must be present on the day your recommended fitter arrives. If they are not
present on the day the fit commences the appliances with not be fitted. 6.3
We are not responsible for appliances supplied to you.
7. Returns, Refunds and Your Right to
Cancel
7.1 Subject to your statutory rights,
products made or altered specifically for you, may not be returned nor will
we provide any refund, unless they are defective or have been accidentally
damaged by us in the course of delivery. 7.2 If we deliver incorrect or damaged
goods for which you require compensation or other remedy, you must report
the defect within 7 days of the date you receive them, or as soon as possible
thereafter by contracting our Customer Services Helpline on 0845 388 1491
Please keep the products purchased in a saleable condition and retain the
original packaging in the condition it was provided. 7.3 We will not be liable
for any damage or loss resulting from repairs attempted by you or third parties.
8. Guarantees and Claims under Guarantee
8.1 The provisions of this clause 8 and
clause 9 below, apply in addition to your statutory consumer rights in relation
to faulty or misdescribed products. These rights are not affected by the guarantee.
8.2 The guarantor is Signature Kitchen Ltd, Unit 3 Clywedog Road South, Wrexham
Industrial Estate LL13 9XS. 8.3 We guarantee all products against faulty workmanship
and/or faulty materials for a minimum period of 3 months from the actual date
of delivery. 8.4 These guarantees do not cover fair wear and tear, neglect,
abuse or misuse of your goods; loss or damage due to fire, smoke, water, lightning,
sunlight, weather, rusting, corrosion, theft or explosion; accidental damage
or loss or damage caused by a third party. 8.5 In the event of a claim under
guarantee occurring, please also phone our Customer Services Helpline on 0845
388 1491. 8.6 We will arrange to repair or replace the defective or incorrect
item free of charge, Should a part no longer be available, it will be replaced
with a part that most closely matches it. 8.7 We will not be liable for any
direct or indirect loss of profits or other financial loss or damage arising
out of defective, damaged or wrongly delivered products over and above the
value of the goods themselves. This does not affect your statutory rights.
9. Site Content and Disclaimers
9.1 Every effort is made to ensure the
complete accuracy of our website, however some prices/details contained on
the website may change from time to time and it is possible that errors will
occur. We will use our best endeavours to rectify any errors, as swiftly as
possible but we cannot be responsible for any loss incurred. 9.2 To the maximum
extent permissible by law, we exclude all warranties, express or implied as
to the accuracy of the information contained in any of the material on this
website. We cannot accept liability for any particular material on the website
or as a result of any use of reliance placed upon the information contained
on this website. 9.3 Any material downloaded or otherwise obtained though
the use of the website is done at your own discretion and risk and that you
will be solely responsible for any damage to you r own computer system of
loss of date that results from the download of any such material.
10. Applicable Law
We control and operate the website from
our offices within England/Wales. Accordingly the laws of England and Wales
govern claims relating to it, including the use of, this website and the materials
contained therein. If you choose to access our website from outside England
and Wales you do so on you own initiative and you hereby agree that in the
event of a dispute between Signature Kitchen Ltd and you the laws of England
and Wales will apply at all time.
